Honduran man living in New Bedford, Massachusetts, sentenced to prison on child rape charges
A former New Bedford man, who was illegally in the U.S. from Honduras, plead guilty to child rape charges on Monday and was sentenced to 12 to 15 years in state prison, Bristol County District Attorney Thomas M. Quinn III announced on Wednesday.
Marvin Pineda, 47, plead guilty on charges of aggravated rape of a child, indecently touching a child and witness intimidation in the Fall River Superior Court and will serve 12 to 15 years in state prison followed by 10 years of supervised probation, the DA said.
The charges stem from an incident on Oct. 10, 2020, when Pineda, an acquaintance of the 9-year-old victim's family from their native country of Honduras, was present at the victim’s home in New Bedford for a family birthday party.
According to the DA, during the party, the victim, her 7-year-old sister and Pineda's two minor children went to a bedroom in the home to go to sleep. The victim's adult sister later found Pineda in the children's bedroom hugging the victim.
When she confronted Pineda, the DA's office said Pineda said he had not seen the victim in some time and was just saying hello.
The DA said the victim's family then offered Pineda to sleep on the couch rather than waking his own children home.
In the morning, the DA said Pineda was no longer on the couch and instead had woken up early and taken his two children from the victim’s home.
The DA said the victim later reported that morning that Pineda had entered her bedroom during the previous night and raped her by digitally penetrating her. The victim was then taken to a local hospital, where a rape kit was performed on her.
Pineda's sperm cells were detected from a swab of the victim's body, the DA said, and the victim's 7-year-old sister, who shared a bed with the victim at the time of the rape, was also a percipient witness to the rape. She said she saw Pineda's genitals.
The DA said Pineda fled Massachusetts on Oct. 11, 2020, and on Oct. 18, 2020, Pineda contacted the victim's mother and urged her not to pursue charges and offered her compensation, a conversation that the DA said the victim's mother reported to police.
Pineda was later found in Texas in November of 2020, where the DA said he was apprehended and brought back to Massachusetts to answer for the charges.
“The defendant took advantage of his access to the child in her bed sleeping next to her sister,” Quinn said. “The conduct of the defendant is reprehensible. On top of that, he immediately fled to Texas and tried to intimidate the victim’s mother. The defendant has similar charges pending in North Carolina. This state prison sentence is well deserved, especially without the victim having to testify.”
